Terms and Conditions of Use and Trade

1. About Us

For the purposes of this document, “K2 & Associates Limited” (also referred to as K2 & Associates Ltd) includes Mind Skills Mastery, a division of K2 & Associates Limited, a company registered in New Zealand. References to “we”, “us”, or “our” mean K2 & Associates Ltd / Mind Skills Mastery. References to “you” mean the user, client, student, or member.

2. Acceptance of Terms

By accessing this website, enrolling in any course, programme, coaching, consulting service, or membership, you agree to be bound by these Terms and Conditions, all applicable New Zealand laws, and any programme-specific terms disclosed at the time of purchase. If you do not agree with these Terms, you must not access or use this website or our services.

3. Privacy & Personal Information

We are committed to protecting your privacy and comply with the Privacy Act 2020.

3.1 Information We Collect We may collect:

c) reverse engineer any software used on the platform;

This license terminates automatically if these Terms are breached.

7. Training, Courses & Coaching – General Terms

Enrolment in any training, course, coaching, or consulting service confirms acceptance of these Terms.
7.1 Payment Terms
• Full payment is required before access or delivery, unless otherwise agreed in writing.
• Payment plans constitute a commitment to pay the full agreed amount.
• Late payments may incur interest at 6% above the bank rate.
• Recovery costs may be charged where permitted by law.

7.2 Behaviour & Removal
Participants must not disrupt learning environments. We reserve the right to remove participants without refund where conduct is inappropriate.

8. Online Courses & Webinars

8.1 Course Delivery
Courses delivered digitally may include:
• Online modules
• Live or recorded sessions
• Downloadable resources
• Private community access
Once payment is processed, access to course materials constitutes delivery of the service.

8.2 Participation & Outcomes
You acknowledge that:
• Participation and completion are your responsibility;
• Results depend on personal application;
• No specific outcomes are guaranteed.
Failure to access or complete content does not entitle you to a refund, except where required under the Consumer Guarantees Act 1993

9. Refund & Cancellation Policy – Online Courses

9.1 Courses Under USD $199
For digital courses priced under USD $199, no refunds are offered once access has been granted, except where required by New Zealand consumer law.

9.2 Courses USD $199 and Over
• More than 15 days before course start: no fee
• Within 14 days: up to 10% fee
• Within 10 days: up to 50% fee
• Within 5 days: no refund
• After course start or access granted: no refunds for non-attendance or non-participation

9.3 Medical Exceptions
Medical cancellations prior to course commencement may be considered upon reasonable evidence. Once access is granted, refunds do not apply except where required by law

10. Laser Coaching – Separate Terms

By purchasing or participating in any Laser Coaching service, you acknowledge and agree that you are bound by the Laser Coaching Terms and Conditions, which can be accessed via the following link: Laser Coaching Terms & Conditions
In the event of any inconsistency, the Laser Coaching Terms and Conditions prevail.

11. In-House Training

11.1 Invoices
Invoices must be paid no later than 15 days prior to the training date. Failure to pay may result in cancellation.

11.2 Cancellation fees
Cancellation fees apply as outlined in clause 9. Refund and Cancellation policy

11.3 Expenses
Pre-approved expenses will be invoiced and payable promptly.

12. Course Changes & Minimum Numbers

We reserve the right to reschedule or cancel courses due to unforeseen circumstances or insufficient enrolments. Where this occurs, alternatives or refunds will be offered as appropriate.

13. Subscription-Based Memberships

13.1 Membership Terms
Memberships may be monthly, annual, or pay-in-full. Minimum terms and pricing are disclosed at enrolment.

13.2 Payments
• Payments are processed via PayPal, Stripe, or direct debit.
• Failure to pay for two consecutive months may result in suspension or cancellation.
• Outstanding fees remain payable.

13.3 Cancellation
Members may resign with written notice. No refunds are provided for part-term cancellations, except where required by law.

13.4 Conduct
Membership may be suspended or terminated where behaviour brings Mind Skills Mastery or the wider NLP & coaching profession into disrepute.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential loss arising from use of our services. Nothing in these Terms limits or excludes your rights under the NZ Consumer Guarantees Act 1993 or NZ Fair Trading Act 1986.

15. External Links

We are not responsible for the content or privacy practices of external websites linked from our site.

16. Changes to These Terms

We may update these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the current version.

17. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand, and you submit to the exclusive jurisdiction of the New Zealand courts.
